In a Court of Appeal case of existence of debt – recovery, RHTLaw Asia acted for a property developer (Respondent) in a debt claim by Lazarus Century Construction Pte Ltd (Appellants) for SGD$1.398 million.
RHTLaw Asia Consultant, Suppiah Thangaveloo (Thanga) successfully persuaded the Court of Appeal to dismiss the Appeal by the Appellants; as there was no evidence of existence of debt being the correct findings by the trial judge in the Judgment.
RHTLaw Asia Consultant Thanga was also able to secure an additional $40,000 on top of the usual $20,000 for a total of $60,000 in security for cost from the Court of Appeal on grounds that Appellants were impecunious without even a bank account.
In dismissing the Appeal, the Court of Appeal awarded $60,000.00 cost to be paid to Thanga’s client by the Appellant. The $60,000.00 security for cost obtained will be released to Thanga’s client solely.
